AnchorPath Systems builds and manages websites for plumbing and local service businesses. The specific scope, deliverables, timeline, and price for any engagement will be described in a separate written proposal or agreement. Where there is a conflict between these Terms and a signed proposal, the signed proposal controls for that engagement.
To deliver the Services, we rely on you to provide accurate business information, content, images, and timely feedback. You are responsible for ensuring that any material you supply does not infringe the rights of others and is lawful and accurate. Delays in providing materials or approvals may affect agreed timelines.
Upon full payment of all amounts due for an engagement, you own the final website content and design deliverables created specifically for you, except for third-party components, fonts, stock assets, and underlying tools or frameworks, which remain subject to their own licenses. AnchorPath Systems retains the right to reuse general know-how, techniques, and non-client-specific code. Unless you request otherwise in writing, we may reference your project and display it in our portfolio and marketing.
Our Services may rely on third-party providers such as hosting platforms, domain registrars, analytics, scheduling, and email tools. Your use of those services may be subject to the providers' own terms, and we are not responsible for their availability, performance, or actions.
While we work to build effective, reliable websites, we do not guarantee specific business outcomes such as a particular number of calls, leads, search rankings, or revenue. The Site and Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
To the maximum extent permitted by law, AnchorPath Systems will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or revenue, arising out of or relating to the Site or Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the Services giving rise to the claim in the three months preceding the event.
Either party may end an ongoing engagement by providing written notice as described in the applicable proposal. Fees already paid are non-refundable except where required by law, and any amounts owed for work performed up to the termination date remain payable. We may suspend or terminate Services immediately for non-payment or for misuse of the Site or Services.
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of laws rules. Any disputes will be subject to the courts located in New York, unless otherwise required by applicable law.
We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date above will reflect the most recent revision. Your continued use of the Site or Services after changes are posted constitutes acceptance of the updated Terms.
